Terms of Service

1. Service

WestMark provides managed cold email outbound services. We send personalized emails on behalf of clients to generate booked discovery calls with qualified prospects.

2. Billing

The service costs $1,500 per month, billed monthly in advance. There are no setup fees, no contracts, and no minimum commitment.

3. Cancellation

You may cancel at any time by emailing jachym@westmarkagency.com. Cancellation takes effect at the end of the current billing period. We provide a pro-rated refund for the unused portion of the current month.

4. Service guarantee

We guarantee 5 qualified discovery calls within the first 60 days of service. If we do not meet this target, we continue working at no additional cost until the 5 calls are delivered. "Qualified" means the prospect matches your ICP and has agreed to a discovery call.

5. Client responsibilities

• Complete the onboarding intake form within 3 business days of signup
• Provide accurate ICP information, differentiation points, and proof points
• Maintain an active calendar link for prospect bookings
• Attend booked discovery calls

6. What we do not provide

• We do not make sales calls or close deals
• We do not provide LinkedIn outreach, paid advertising, or content marketing
• We do not offer strategy consulting beyond what is needed to run the outbound campaigns

7. Limitation of liability

Our total liability is limited to the fees paid by the client in the 30 days preceding any claim. We are not liable for indirect, incidental, or consequential damages. We do not guarantee any specific revenue outcome; the deliverable is booked discovery calls, not closed deals.

8. Changes

We may update these terms. Material changes will be communicated via email at least 14 days before they take effect.
